The legal side of hiring

It pays to pay attention to the admin of hiring. I have seen businesses make the critical mistake of not doing their hiring right. The CCMA’s offices are filled with even established businesses that have fallen on the wrong side of the law. Don’t think it can’t happen to you.

186 902 cases were referred to the CCMA in 2017/18.

Labour law in South African is difficult to manage, but the Department of Labour and the CCMA have recently launched a portal to help small business. It’s a good idea to get familiar with the basic concepts of labour law as you do your first hire. Doing your homework now will save you headaches later on.

A good place to start is the “How to recruit and select employees” page, which covers:

  • Who you can employ
  • How to select the right employee
  • How to ensure your process is non-discriminatory

This portal also offers small businesses tips and guides on managing employees. From the proper practices for hiring to retrenchment, it is an easy way to ensure you stay on the right side of the law.

You can also download templates for contracts, disciplinary notices and other necessary documents.

Now that you know how to handle labour law, how do you handle the interview?
